Aug. 23rd, 2005 12:07 pmThe California courts have determined that gay domestic partners have as much parental rights of custody as the biological parent in the relationship. The case in question had a long-term and registered lesbian couple splitting up, and the non-biological mother wanting custody as well as the biological mother. The courts bought the "equal protection" argument, thus granting "domestic partnerships" one more marital right/responsibility.
The blue-nosed cultural conservatives (as opposed to us long-haired reasonable conservatives) are screaming bloody murder, as usual. They're all up in arms that this is destroying marriage.
And for once, they're correct.
But what they're not wrapping their tiny little pea-brains around is this: it is the denial of marital rights to homosexuals which led to this. If this couple had been allowed to marry, as opposed to getting the state domestic partner coupon, this entire case never would have come up.
But now, thanks to the exactly just doctrine of equal protection, marriage itself has now lost one of its exclusive powers to a lesser commitment.
If those bone-heads really want to defend marriage itself, they'd better extend it to everybody.
